Your personal, financial, asset, sensitive or any other type of personal data, both yours and that of the natural person you represent, which have been provided to EIKOS by any physical or electronic means (hereinafter the "Personal Data"), will be used by EIKOS for the fulfillment of EIKOS's obligations arising from any existing, possible or future relationship of any nature between you and EIKOS. Data obtained subsequently may be used by EIKOS, including sensitive data such as health data, among others. Purposes and Use of Your Personal Data
Your Personal Data, both yours and that of the natural person you represent, where applicable, including without limitation personal, financial, asset and/or sensitive data, as well as all those data contained in the documentation delivered by you to us or those delivered subsequently as a result of our business relationship, as well as the updating of such data, may be used by EIKOS or delivered by it to other agents, reinsurance intermediaries, insurance companies, reinsurers, assistance service providers and other natural or legal persons who by law must have access to your Personal Data, to the extent that the use and transmission thereof for as long as necessary is required for: (i) the analysis of the possible contracting of EIKOS's services and products, (ii) the fulfillment of the contractual obligations that you have or may have with EIKOS or with any of its affiliates or subsidiaries; (iii) carrying out the necessary acts with your bank for the processing of payment for the products or services you acquire; (iv) carrying out and/or complying with audits performed on EIKOS, its affiliates or subsidiaries, whether by external auditors, governmental entities or any of EIKOS's affiliates or subsidiaries; (v) sending notifications, notices, magazines, advertisements or publicity about our products or services or topics that we consider may be of interest to you, as well as news, communications or advertising of EIKOS or its related companies; (vi) creating databases (including databases regarding sensitive data) for administrative purposes, or any other purpose related to the pursuit of your relationship with EIKOS; (vii) providing information required by governmental entities or authorities in compliance with the regulations applicable to EIKOS's business in the United Mexican States or abroad; (viii) handling any complaint, question or comment; (ix) sending you notifications of changes to this privacy notice; and (x) any other similar or analogous activity to the foregoing.
The transfer of your Personal Data to third parties shall be for the purpose of duly fulfilling the purposes mentioned above, therefore you accept the transfer and use of your Personal Data.
Security Measures
EIKOS shall adopt all and every one of the administrative, physical and technical security measures necessary to safeguard your personal information. Likewise, should a third party need to know such information, EIKOS shall require such third parties to comply with this Privacy Notice and its modifications, as well as to adopt the administrative, physical and technical security measures established in the Regulations, in order to protect the personal data that you voluntarily provide to us.
Your Rights of Access, Rectification, Opposition and Cancellation
Likewise, you may request access to your data, rectify it, cancel it, oppose it, limit its use or disclosure, or revoke your consent, in terms of the Federal Law on Protection of Personal Data Held by Private Parties (the "Law") and other applicable provisions. To exercise these rights, you must contact the Compliance Department at the email address indicated above in our contact information.
In accordance with applicable law, any request to exercise the aforementioned rights must include: (i) your name and address (essential requirements to provide you with a response); (ii) a copy of your official identification (passport or voter ID); (iii) a clear and precise description of the Personal Data to which you wish to access or that you wish to rectify, cancel or oppose, and any other element that facilitates the location of your data; as well as (iv) any other requirement established by the Law and/or other applicable provisions at the time of submission of your request and/or that are necessary to identify you as the owner of such data.
Transfer of Your Personal Data
As part of the management and administration of EIKOS's business and its clients, we may share all or part of your Personal Data with our parent company and/or all or any of our affiliate companies, subsidiaries, licensees, and/or those belonging to the same economic group in Mexico and abroad; as well as with employees, contractors or subcontractors, reinsurance intermediaries, insurance companies, reinsurers, assistance service providers and/or EIKOS advisors, as well as any other third party who may need to have access to your personal data, who may or may not process your Personal Data on behalf of EIKOS.
EIKOS shall not share or transfer your Personal Data to third parties except as provided in this notice, the Law or any other applicable legislation or regulation.
Storage of Your Personal Data
EIKOS, by itself or through any of its affiliates, subsidiaries or third parties hired for this purpose, may keep your Personal Data in databases located in Mexico or abroad without any limitation, in accordance with the time periods established by applicable legislation. In accordance with the principles set forth in the personal data protection regulations, EIKOS shall not keep documents containing your personal data longer than necessary, including a reasonable period for you, if you so request EIKOS in writing, to retrieve them.
Modifications to the Privacy Notice, Applicable Legislation and Jurisdiction
EIKOS reserves the right to modify the terms and conditions of this Privacy Notice, in which case the modification shall be notified through the means of communication that EIKOS deems most appropriate for such purpose and/or an announcement on our website. In any case, you shall have the right to cancel and/or rectify your Personal Data, as well as to limit its use and disclosure in the event of modifications to the terms of this Privacy Notice.
This Privacy Notice, the processing of your Personal Data and/or all related documents are governed by the Law and other laws and regulations of Mexico. Acceptance of this Privacy Notice or the mere request for or contracting of our services or the execution of a contract of any nature with EIKOS, once the Privacy Notice has been made available, implies express and written acceptance of its terms and express submission to the courts of Mexico City, Federal District, for any controversy or claim arising from this Privacy Notice, expressly waiving any other jurisdiction that by reason of domicile, present or future or any other cause might correspond to them.
